  • Plaid: For account aggregation (subject to Plaid's Terms)

We are not responsible for the practices of third-party services. Your use of such services is at your own risk.

8. Subscription and Billing

Certain features require a paid subscription. By subscribing, you agree to:

  • Pay all applicable fees as described at time of purchase
  • Authorize recurring charges for subscription plans

Subscriptions automatically renew unless cancelled before the renewal date. Refunds are provided in accordance with our refund policy.

You retain ownership of your portfolio data. By using the Service, you grant us a limited license to use your data solely to provide the Service.

  • WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS
  • WE ARE NOT RESPONSIBLE FOR INVESTMENT LOSSES OR TAX CONSEQUENCES

11. Indemnification

You agree to indemnify and hold harmless FolioLens and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

We may terminate or suspend your account at any time for any reason, including violation of these Terms. Upon termination:

  • Your right to use the Service immediately ceases
  • You may request export of your data within 30 days
  • We may delete your data after a reasonable retention period

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.

14. Dispute Resolution

Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
